What an absolutely harrowing day. When we arrived my daughter told the DA she would be representing us today and would like to participate in any discussions in the judge's chambers. The DA delivered that message but the judge would not allow it. In addition, she said she would not allow a continuance and the re-sentencing would go forward today. My daughter had also told the DA she would like to address the court regarding some erroneous information sent by the Probation Dept. and thankfully the judge allowed her to speak. We still can't figure out why the judge said we should have known we were entitled to counsel simply because we were present at the hearing on Feb. 22. Our presence there didn't mean we knew we could have an attorney, but the judge wouldn't listen. Then my daughter told the judge the Probation Dept., even though they said they did in their report, hadn't sent us information so we could apply for restitution and the Probation Dept. acknowledged that.

So, not based on the fact that we weren't advised we could have counsel, but rather on the fact we had not been allowed to submit for restitution, she continued the hearing until April 25 - 6 weeks from today. I was a nervous wreck in the beginning thinking I would have to do my impact statement today, but maybe my angel in heaven helped me out along with your prayers and good wishes.

Thank you for your thoughts and prayers. I have 6 weeks to make myself a good speaker. That's going to be a BIG job.

Sandi, I've been thinking of you all day! The anticipation is the worst usually because once you start to speak the words will flow - probably with the tears. Maybe an outline of what you want to say and then speak from your heart. Write your thoughts down so you don't keep going over and over them the next 6 weeks. Take a big deep breath and hit the road! Big hug!!

Anita gave the perfect advice. You'll do fine - write down the main points, practice a little & then let it flow from the heart. Please remind us as April 26th gets closer so you'll have an army praying & supporting you.

Thanks for the advice Anita and Catherine. I forgot to add another thing that worked in our favor today. The judge appeared to be sick, maybe a bad cold. She could only say 2 or 3 words then cough. Two or 3 words then cough. When my daughter was trying to talk, the judge would cough and my daughter would stop because she didn't think the judge could hear while she was coughing. Maybe the judge realized how hard it was going to be and how bad she felt and maybe that contributed to her being willing to do the continuance. Whatever works right?

The attorney we've chosen is a hoot! My daughter sent her an email to let her know what happened and because of something the judge said, my daughter wanted to meet with her and to also make sure my ex and I will be able to speak on April 25. This is the answer our attorney sent (remember she's the one my daughter said sounded like a "pit bull" on the phone):

"Yes we can meet, I can do the 25, the judge is an idiot and your parents can speak."

Sandi, I'm so glad you got the continuance. I think the lawyer you've got sounds great and your daughter did a fantastic job. I know you wanted the continuance, but now hang on tight, because this next six weeks will be hard too. I can't say anything better than what Anita did. Hugs.

Thank God for small miracles! At least you got the continuance so you, your daughter and 'the pit bull' can properly prepare. As everyone has said, prepare your thoughts so you can remember everything you want to say.

Wow! So sorry you have to endure this, Sandi, but sounds like you got the right attorney. I loved her comment about the judge and would love to hear what else she has to say...the things you can share, of course. My thoughts and prayers are with you ;)
