What an absolutely harrowing day. When we arrived my daughter told the DA she would be representing us today and would like to participate in any discussions in the judge's chambers. The DA delivered that message but the judge would not allow it. In addition, she said she would not allow a continuance and the re-sentencing would go forward today. My daughter had also told the DA she would like to address the court regarding some erroneous information sent by the Probation Dept. and thankfully the judge allowed her to speak. We still can't figure out why the judge said we should have known we were entitled to counsel simply because we were present at the hearing on Feb. 22. Our presence there didn't mean we knew we could have an attorney, but the judge wouldn't listen. Then my daughter told the judge the Probation Dept., even though they said they did in their report, hadn't sent us information so we could apply for restitution and the Probation Dept. acknowledged that.
So, not based on the fact that we weren't advised we could have counsel, but rather on the fact we had not been allowed to submit for restitution, she continued the hearing until April 25 - 6 weeks from today. I was a nervous wreck in the beginning thinking I would have to do my impact statement today, but maybe my angel in heaven helped me out along with your prayers and good wishes.
Thank you for your thoughts and prayers. I have 6 weeks to make myself a good speaker. That's going to be a BIG job.
